This End User License Agreement (“Agreement”) is between you and Hyppe Enterprise, LLC (“Hyppe Enterprise, LLC”, “we”, “us”), the company that makes Kash. It covers the Kash mobile app, trykash.com, the waitlist and member cards (together, “Kash”). By downloading, installing or using Kash, you agree to this Agreement. If you don’t agree, don’t use Kash.
1. License
Kash is licensed to you, not sold. Subject to this Agreement, we give you a personal, limited, non-exclusive, non-transferable, revocable license to use Kash for your own non-commercial purposes, on devices you own or control.
2. What you may not do
- Copy, modify, translate or create derivative works of Kash, except as the law expressly allows.
- Reverse engineer, decompile or try to extract Kash’s source code, except where the law permits it despite this restriction.
- Rent, lease, sell, sublicense or redistribute Kash.
- Remove or change any copyright, trademark or other notices.
- Use Kash to break the law, to infringe anyone’s rights, or to interfere with Kash or its security.
- Use the member card to impersonate someone, or with a handle or name you don’t have the right to use.
3. Not financial advice
Kash helps you organize your paychecks and expenses and does calculations, such as how much is left of a paycheck, whether an expense fits, and how long a debt takes to pay off. These results are estimates based on the information you enter, for your information only. Kash is not a bank, lender, broker or licensed financial advisor, and does not provide financial, investment, tax or legal advice. Check important numbers and decisions yourself or with a qualified professional. You are responsible for your financial decisions.
4. Your data
The information you enter in the Kash app is stored on your device. You are responsible for your device, its security and any backups. Our Privacy Policy explains how we handle the information you share with us, such as your waitlist email.
5. Member cards
You keep the rights to the handle and name you put on your member card. You give us permission to use them to create and show your card to you. Once you download and share your card, you are responsible for where you post it.
6. Copyright and trademarks
Kash, including its software, design, text, graphics, the “Kash” name and logo, the blackletter “K” and the “People with Kash” tagline, is owned by Hyppe Enterprise, LLC and protected by copyright, trademark and other laws. © 2026 Hyppe Enterprise, LLC. All rights reserved. Except for the license above, this Agreement doesn’t give you any rights to our intellectual property. If you send us feedback or ideas, we may use them without any obligation to you.
7. Updates and availability
We may update, change or stop offering any part of Kash at any time. Kash is currently on a waitlist, and joining it doesn’t guarantee access by a specific date. Some updates may be required to keep using the app.
8. Termination
This Agreement lasts until you or we end it. You can end it by deleting Kash. It ends automatically if you break it. When it ends, you must stop using Kash and delete it. Sections 3, 6, 9, 10, 11 and 13 continue after it ends.
9. Disclaimer of warranties
To the maximum extent the law allows, Kash is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that Kash will be uninterrupted, error-free or that its calculations will meet your needs.
10. Limitation of liability
To the maximum extent the law allows, Hyppe Enterprise, LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, profits, data or goodwill, arising from your use of Kash or decisions you make based on it. Our total liability for any claim related to Kash will not exceed the greater of the amount you paid us for Kash in the 12 months before the claim, or US$50. Some places don’t allow these limits, so they may not fully apply to you.
11. Indemnity
You agree to defend and hold harmless Hyppe Enterprise, LLC from claims arising from your misuse of Kash or your violation of this Agreement, to the extent the law allows.
12. App Store terms
If you download Kash from Apple’s App Store or Google Play, you also agree to their terms. For apps downloaded from Apple’s App Store:
- This Agreement is between you and Hyppe Enterprise, LLC only, not Apple. Hyppe Enterprise, LLC, not Apple, is solely responsible for Kash and its content.
- Your license is limited to using Kash on Apple-branded products you own or control, as permitted by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for Kash.
- If Kash fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation regarding Kash.
- Hyppe Enterprise, LLC, not Apple, is responsible for addressing any claims relating to Kash, including product liability claims, claims that Kash fails to meet legal or regulatory requirements, and consumer protection claims.
- Hyppe Enterprise, LLC, not Apple, is responsible for the investigation, defense, settlement and discharge of any claim that Kash infringes a third party’s intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
13. General
This Agreement is governed by the laws of the United States and the state in which Hyppe Enterprise, LLC is organized, without regard to conflict of laws rules, except where the law of your country of residence requires otherwise. If any part of this Agreement can’t be enforced, the rest stays in effect. Not enforcing a right isn’t a waiver of it. You may not transfer this Agreement; we may transfer it as part of a merger, acquisition or sale of assets. This Agreement, together with the Privacy Policy, is the entire agreement between you and us about Kash. We may update it; we’ll change the date at the top and, for significant changes, let you know before they take effect.
